MHSA Section 16.7: Missing Person Locator Compliance Guide

South African mining law does not treat a missing worker as an operational inconvenience. It treats it as a life-threatening emergency with legal obligations attached. For safety managers and procurement teams, the practical question is simple: what does the Mine Health and Safety Act require, and what technology satisfies it?

What the Requirement Means in Practice

The Mine Health and Safety Act (Act 29 of 1996) places a duty on employers to ensure, as far as reasonably practicable, a safe working environment, and this extends to the ability to account for and locate personnel on the mine. Section 16.7 requirements relate to locating missing persons: when a worker cannot be accounted for, the mine must be able to establish where that person is, or where they were last known to be, so that an effective emergency response can be mounted.

In practical terms, compliance means a mine can answer three questions at any moment during a shift. Who is on site? Where is each person now? And if someone’s signal is lost, where were they when it happened?

Manual systems, such as tally boards, sign-in registers, and radio check-ins, technically address accountability but fail the speed test. They tell you someone is missing at shift end, hours after the fact, and they tell you nothing about where to look.   • Run a simulated missing person drill and measure time from alert to location confirmation.
  • Ensure movement replay data is retained and retrievable for incident investigation.
  • Keep certification documentation current, including ICASA approval for RF equipment operating in South Africa.

Beyond South Africa

Personnel accountability requirements are not unique to the MHSA. Regulators in other mining jurisdictions impose equivalent duties on operators to know who is on site and to locate personnel in an emergency, and multinational mining houses commonly apply a single global standard across their operations.
