DMPR Level 9: What South Africa’s Renamed Mining Regulator Means for Collision Avoidance Compliance

What Is Level 9 Under DMPR Regulations?

Level 9 is the highest tier of vehicle interaction control recognised by the Earth Moving Equipment Safety Round Table (EMESRT) framework, and it’s the tier South Africa has written into binding law. The relevant sub-regulations — 8.10.1.2(b) and 8.10.2.1(b) of Chapter 8 — were signed into force on 21 December 2022, and they apply to all diesel-powered trackless mobile machinery, both surface and underground.

At its core, DMPR Level 9 requires a system that can:

  • Automatically detect the presence of any pedestrian or other machine within a vehicle’s vicinity
  • Warn both the operator and the pedestrian of each other’s presence through an effective alert
  • Automatically retard the machine to a safe speed if no corrective action is taken
  • Apply the brakes automatically where a collision risk remains
  • Fail to safe without requiring human intervention

That last point is what separates Level 9 from every level beneath it. Level 7 systems only create pedestrian and machine awareness. Level 8 systems add advisory alerts to the operator. Only Level 9 takes physical control of the vehicle — slowing or stopping it mechanically when a collision risk is detected, independent of whether the operator reacts.

Why DMPR Level 9 Compliance Is Non-Negotiable

Non-compliant mines are, by definition, breaking the law — and that exposes an operation to closure risk under Section 54 of the Mine Health and Safety Act. Mines that are not yet compliant are expected to apply for exemption with a documented timeline, milestones, and deliverables.
